For failing to correctly categorize a series of materials as either promotional or non-promotional at the outset, and to thus correctly certify them, together with failing to certify the final form of promotional material, Pharmaxis was ruled in breach of the following clauses of the Code:

Clause 2 - Bringing discredit upon, and reducing confidence in, the pharmaceutical industry

Clause 9.1 - Failing to maintain high standards

Clause 14.1 - Failing to certify material in its final form

Clause 14.3 - Failing to certify a medical and educational good and service

Clause 14.3 - Certifying a promotional medical and educational good and service
